DMCA Notice

1. STATEMENT OF NON-INFRINGEMENT AND SAFE HARBOR

1.1. Kreedex Ltd ("Company", "We", "Us", or "Our"), which operates the website and marketplace platform www.racoon.gg ("Platform"), acts strictly as an online marketplace, commercial agent, and hosting intermediary. As defined in Section 2 and Section 12.3 of our Terms and Conditions, all listings, descriptions, digital assets, and virtual goods are created, uploaded, and managed exclusively by independent third-party Sellers and Workers.

1.2. The Company respects the intellectual property rights of others and expects its users, sellers, and workers to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and international copyright regulations, we maintain a strict procedure for receiving notices of claimed infringement and responding appropriately.

1.3. Pursuant to Title II of the DMCA and equivalent international safe harbor protections, the Company is not liable for monetary damages or injunctive relief for copyright infringements occurring on the Platform via user-generated content, prior to receiving a valid, formalized takedown notice.

If you are a copyright owner, or authorized to act on behalf of one, and you believe that any material hosted on or listed through our Platform infringes your copyright, you may submit a formal written notice to our Designated Copyright Agent via email at: info@racoon.gg.

To be legally effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include the following information in writing:

  1. Electronic or physical signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work: A clear and detailed description of the copyrighted work that you claim has been infringed (or, if multiple works are covered by a single notification, a representative list of such works).
  3. Identification of the infringing material: Specific identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the exact URL(s), product listings, or direct links within the Platform to enable us to locate the material.
  4. Contact information: Information reasonably sufficient to permit our support team to contact you, such as your full legal name, physical address, telephone number, and an email address.
  5. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Failure to include all of the elements listed above may result in a delay or rejection of your takedown request.

3. COMPANY POLICY UPON RECEIVING A VALID NOTICE

Upon receipt of a valid, fully compliant written DMCA Notice, the Company will execute the following automated and administrative protocol:

  • Expeditious removal: We will promptly remove, disable, or restrict access to the allegedly infringing material hosted on the Platform.
  • Notification to the Seller/Worker: We will take reasonable steps to immediately notify the independent Seller or Worker who uploaded the material that access to the content has been disabled.
  • Account Sanctions: Per Section 6.4 and Section 12.1 of our Terms and Conditions, recurring or malicious intellectual property violations will result in the immediate and permanent termination of the Seller's or Worker's Account, along with the permanent forfeiture of any internal platform balances.

4. HOW TO FILE A COUNTER-NOTIFICATION

If your content or listing was removed or disabled as a result of a DMCA Notice, and you believe this occurred due to a mistake, misidentification, or misinterpretation, you have the right to file a formal written Counter-Notification to our Designated Copyright Agent at info@racoon.gg.

Your Counter-Notification must include the following elements:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the specific URL/location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your full legal name, physical address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the competent courts of the Republic of Seychelles, and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

5. REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable international laws, the Company implements a strict "Repeat Infringer Policy." If any independent Seller or Worker is found to have uploaded infringing content, unauthorized promotional graphics, or copyrighted materials on more than two (2) separate occasions, their access to the marketplace will be revoked, and all active listings will be permanently expunged.

WARNING: Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity on an online platform is infringing a copyright may be held legally liable for damages. This includes reimbursement for all legal fees, court costs, and administrative expenses incurred by the Company, the alleged infringer, or the copyright owner as a result of reliance upon such misrepresentation.

If you are unsure whether the material hosted on our Platform actually infringes your copyright, we strongly recommend that you contact a qualified legal advisor before submitting a formal DMCA Notice.
